A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), APPROVING AN AMENDMENT TO THE CITY OF MIAMI (β€œCITY”) LOCAL HOUSING ASSISTANCE PLAN (β€œLHAP”), ATTACHED AND INCORPORATED, FOR FISCAL YEARS (β€œFY”) 2025-2028 IN ACCORDANCE WITH THE STATE HOUSING INITIATIVES PARTNERSHIP (β€œSHIP”) ACT; INCORPORATING A MANUFACTURED HOUSING STRATEGY PURSUANT TO SECTION 420.9075, FLORIDA STATUTES; FURTHER AUTHORIZING THE CITY MANAGER TO SUBMIT THE AMENDED PLAN TO THE FLORIDA HOUSING FINANCE CORPORATION FOR APPROVAL; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE.

WHEREAS, in July 1992, the State of Florida enacted the William E. Sadowski Affordable Housing Act (β€œSadowski Act”), which provides for the allocation of a portion of new and existing documentary stamp taxes on deeds on real estate transactions to local governments for the development and maintenance of affordable housing; and

WHEREAS, the Sadowski Act provided a dedicated revenue source for affordable housing and created the State Housing Initiative Partnership (β€œSHIP”) Program; and

WHEREAS, pursuant to Section 420.9072(2)(a) of the Florida Statutes, a county or eligible municipality must submit to the Florida Housing Finance Corporation (β€œFHFC”) its Local Housing Assistance Plan (β€œLHAP”) describing the local housing assistance strategies to be eligible to receive funds under the program; and

WHEREAS, on June 24, 2025, pursuant to Resolution No. R-25-0290, the Miami City Commission approved the City of Miami’s (β€œCity”) LHAP, for the period of July 1, 2025, through June 30, 2028; and

WHEREAS, Senate Bill 594 requires that local governments update include strategies in their LHAP that address the housing needs of mobile homeowners, including lot rental assistance, rehabilitation/emergency repair assistance, and displacement assistance due to mobile home park closures; and

WHEREAS, the Florida Legislature passed Senate Bill 594, which amended Sections 420.9072 and 420.9075, Florida Statutes, effective July 1, 2026; and

WHEREAS, the Department of Housing and Community Development has prepared an amendment to the Fiscal Years (β€œFY”) 2025-2028 LHAP to incorporate a Manufactured Housing Program Strategy in full compliance with the state statutory updates; and

WHEREAS, the City Administration recommends approving the City’s LHAP amendment for FY 2025-2028, as specified in Exhibit β€œA,” attached and incorporated, to incorporate a Manufactured Housing strategy to meet the requirements under section 420.9075, Florida Statutes;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA:

Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section.

Section 2. The amendment of the City’s LHAP for FY 2025-2028, as specified in Exhibit β€œA,” attached and incorporated, to incorporate a Manufactured Housing strategy to meet the requirements under section 420.9075, Florida Statutes, is approved.ΒΉ

Section 3. The City Manager is authorized to submit the proposed LHAP amendment to the Florida Housing Finance Corporation for review and approval, and to negotiate and execute all necessary documents to implement the terms and conditions of the SHIP Program and the LHAP.

Section 4. This Resolution shall become effective immediately upon its adoption.
