CA.7 - A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST JOSE VIL FOR DAMAGES RESULTING FROM A MOTOR VEHICLE ACCIDENT THAT OCCURRED ON JUNE 28, 2022 AND TO SEEK ALL LEGAL REMEDIES AVAILABLE TO THE CITY OF MIAMI IN LAW OR EQUITY.

WHEREAS, on June 28, 2022, Jose Vil was the driver of a vehicle that collided into a City of Miami (“City”) vehicle driven by a City employee in or around Northwest 119th Street, Miami, Florida; and
WHEREAS, Mr. Vil was at fault for the accident and cited for Failure to Yield Right of Way while making a left turn; and
WHEREAS, as a result of the accident, the City of Miami suffered property damage in the amount of Ten Thousand, Five Hundred Twenty-Four and 00/100 Dollars ($10,524.00); and
WHEREAS, the City endeavored to resolve this dispute without court intervention to no avail; and
WHEREAS, to date, the damages suffered by the City remain unpaid; and
WHEREAS, the City wishes to proceed with legal action against Mr. Vil, to recover damages resulting from the above accident;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Attorney is authorized to proceed with legal action, if necessary, against Jose Vil to recover damages and to seek any other legal remediesavailable to the City in law or equity.
Section 3. This Resolution shall become effective immediately upon its adoption.
