A RESOLUTION OF THE MIAMI CITY COMMISSION APPROVING A NOISE WAIVER PURSUANT TO SECTIONS 36-4(A) AND (C) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), TITLED "OPERATION OF RADIOS, PHONOGRAPHS OR OTHER SOUND-MAKING DEVICES; BANDS, ORCHESTRAS AND MUSICIANS–GENERALLY; EXEMPTION,” AND SECTION 36-5(A) AND (C) OF THE CITY CODE, TITLED “SAME – HOURS OF OPERATION OF JUKEBOXES, RADIOS, ETC.; EXEMPTION FOR EVENT ON CITY-OWNED PROPERTIES; RELAXATION,” FOR THE FIFA FAN FESTIVAL BEING HELD IN DOWNTOWN MIAMI AT BAYFRONT PARK, LOCATED AT 301 BISCAYNE BOULEVARD, MIAMI, FLORIDA, WHICH IS OCCURRING ON VARIOUS DATES FROM JUNE THROUGH JULY OF 2026; FURTHER WAIVING THE REQUIREMENTS OF SECTION 38-113 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED.

WHEREAS, Miami-Dade County is a host site for FIFA World Cup matches and the City of Miami (“City”) is host to the FIFA Fan Festival (“Event”) at the site located in Bayfront Park in Downtown Miami (“Event Site”); and
WHEREAS, whether matches are being played locally or in the other FIFA World Cup venues, the Event Site will be open and hosting fans who will be able to watch matches on large screens specially set up for this Event; and
WHEREAS, the dates of required waiver are Saturday, June 13 (Haiti v. Scotland match) (Ending Time 12 AM); Tuesday,June 16 (Argentina v. Algeria match) (Ending Time 12 AM); Friday, June 19 (Brazil v. Haiti & Turkey v. Paraguay) (Ending Time 12 AM); Tuesday, June 23 (Colombia v. DR Congo) (Ending Time 1 AM); Thursday, June 25 (Turkey v. USA & Paraguay v. Australia) (Ending Time 1 AM); Saturday, June 27 (Jordan v. Argentina) (Ending Time 1 AM); Monday,June 29 (Round of 32) (Ending Time 12 AM); Tuesday, June 30 (Round of 32) (Ending Time 12 AM); and Saturday, July 4 (Round of 16) (Ending Time 12 AM); and
WHEREAS, Section 36-4(a) of the Code of the City of Miami, Florida, as amended, ("City Code") prohibits excessive noise or music audible at a distance of one hundred (100) feet from a building or structure or vehicles from where it is produced; and
WHEREAS, Section 36-4(c)(1) of the City Code provides that the City Commission may declare an exemption from Section 36-4(a) of the City Code for special occasions by Resolution; and
WHEREAS, Section 36-5(a) of the City Code limits noise disturbances to those in repose from the hours of 11:00 pm to 7:00 am; and
WHEREAS, Section 36-5(c) of the City Code provides that the City Commission may declare an exemption from section 36-5(a) of the City Code for special occasions by Resolution; and
WHEREAS, all other requirements of the City Code such as building, special event permitting and other code matters are still required to be met; and
WHEREAS, the waiver end time for each Event at the Event Site will be as follows per Event: Saturday, June 13 (Haiti v. Scotland match) (Ending Time 12 AM); Tuesday, June 16 (Argentina v. Algeria match) (Ending Time 12 AM); Friday, June 19 (Brazil v. Haiti & Turkey v. Paraguay) (Ending Time 12 AM); Tuesday, June 23 (Colombia v. DR Congo) (Ending Time 1 AM); Thursday, June 25 (Turkey v. USA & Paraguay v. Australia) (Ending Time 1 AM); Saturday, June 27 (Jordan v. Argentina) (Ending Time 1 AM); Monday, June 29 (Round of 32) (Ending Time 12 AM); Tuesday, June 30 (Round of 32) (Ending Time 12 AM); and Saturday, July 4 (Round of 16) (Ending Time 12 AM);
WHEREAS, the City Commission further finds it is in the best interests of the City to waive Section 38-113 of the City Code, for the Event;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The noise prohibition contained in Section 36-4(a) of the City Code is waived pursuant to Section 36-4(c)(1) of the City Code, titled "Operation of radios, phonographs or other sound-making devices; bands, orchestras and musicians–Generally; exemption" for:
1.Saturday, June 13, 2026;
2.Tuesday, June 16, 2026;
3.Friday, June 19, 2026;
4.Tuesday, June 23, 2026;
5.Thursday, June 25, 2026;
6.Saturday, June 27, 2026;
7.Monday, June 29, 2026;
8.Tuesday, June 30, 2026; and
9.Saturday, July 4, 2026.
Section 3. The noise prohibition contained in Section 36-5(a) of the City Code is waived pursuant to Section 36-5(b) of the City Code, titled "Same – Hours of operation of jukeboxes, radios, etc.; exemption for events of City-owned property; relaxation " for:
1.Saturday, June 13, 2026;
2.Tuesday, June 16, 2026;
3.Friday, June 19, 2026;
4.Tuesday, June 23, 2026;
5.Thursday, June 25, 2026;
6.Saturday, June 27, 2026;
7.Monday, June 29, 2026;
8.Tuesday, June 30, 2026; and
9.Saturday, July 4, 2026.
Section 4. The Event must comply with all other requirements of the State, Local and City law including building and special event permitting.
Section 5. The waiver for each Event at the Event Site shall end by the end time outlined below per Event:
1.Saturday, June 13 (Haiti v. Scotland match) = Ending Time 12 AM;
2.Tuesday, June 16 (Argentina v. Algeria match) = Ending Time 12 AM;
3.Friday, June 19 (Brazil v. Haiti & Turkey v. Paraguay) = Ending Time 12 AM;
4.Tuesday, June 23 (Colombia v. DR Congo) = Ending Time 1 AM;
5.Thursday, June 25 (Turkey v. USA & Paraguay v. Australia) = Ending Time 1 AM;
6.Saturday, June 27 (Jordan v. Argentina) = Ending Time 1 AM;
7.Monday, June 29 (Round of 32) = Ending Time 12 AM;
8.Tuesday, June 30 (Round of 32) = Ending Time 12 AM; and
9.Saturday, July 4 (Round of 16) = Ending Time 12 AM;
Section 6. Any violation of this Waiver or the requirement of State, Local and City law shall result in a revocation of the Waiver for the remainder of the Event.
Section 7. The requirements set forth in Section 38-113 of the City Code are hereby waived for the Event at the Event Site.
Section 8. This Resolution shall become effective immediately upon its adoption.
