A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE A TEMPORARY ACCESS AGREEMENT BETWEEN THE CITY OF MIAMI (“CITY”) AND GREATER ST. PAUL A.M.E. CHURCH, INC., FOR THE TEMPORARY USE OF CITY-OWNED REAL PROPERTY LOCATED AT 3501 PLAZA STREET, MIAMI, FLORIDA, FOR CONSTRUCTION-RELATED ACTIVITIES IN CONNECTION WITH THE AFFORDABLE HOUSING PROJECT BEING DEVELOPED ON THE ADJACENT PROPERTY, FOR A PERIOD NOT TO EXCEED NINETY (90) DAYS; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ALL OTHER DOCUMENTS INCLUDING AMENDMENTS, EXTENSIONS, AND RENEWALS, ALL IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, AS MAY BE NECESSARY FOR SAID PURPOSE, AND IN COMPLIANCE WITH ALL APPLICABLE LAWS, RULES, AND REGULATIONS.

WHEREAS, on March 6, 2026, pursuant to Resolution No. R-25-0490, the City of Miami(“City”), acquired two (2) parcels of land, including that certain parcel located at 3501 Plaza Street, Miami, Florida (“Property”), for the purpose of constructing a new park; and

WHEREAS, Greater St. Paul A.M.E. Church, Inc., a Florida not-for-profit corporation (“Licensee”), is developing an affordable housing project on the adjacent parcel located at 3574 William Avenue, Miami, Florida, including the construction of improvements in furtherance of that purpose; and

WHEREAS, Licensee has requested the temporary use of a portion of the Property for the installation and maintenance of temporary structural supports, including shoring and related construction activities, necessary to facilitate such improvements; and

WHEREAS, the City has not yet commenced construction of the park and has determined that it is in the City’s best interest to authorize the City Manager to negotiate and execute a Temporary Access, Indemnification, and Hold Harmless Agreement (“Agreement”) with Licensee, permitting limited use of the Property for the purposes set forth herein, without impacting the City’s planned timeline for construction of the park;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA:

Section 1.  The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section.

Section 2.  The City Manager is authorized to negotiate and execute the Agreement, in a form acceptable to the City Attorney, with Licensee for a period not to exceed ninety (90) days, to access the Property for the installation of temporary structural supports, shoring, and related construction activities.

Section 3. The City Manager is further authorized1 to negotiate and execute all necessary documents, including amendments and modifications as may be necessary to effectuate said Agreement, all in forms acceptable to the City Attorney and in compliance with all applicable laws, rules, and regulations.

Section 4.  This Resolution shall become effective immediately upon its adoption.
