A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY OF MIAMI ("CITY") POLICE DEPARTMENT TO PROVIDE A DONATION IN AN AMOUNT NOT TO EXCEED SEVENTY-FIVE THOUSAND AND 00/100 DOLLARS ($75,000.00) TO AMPLIFY COMMUNITY RESOURCES, INC., A FLORIDA NOT FOR PROFIT ORGANIZATION, FOR FINANCIAL ASSISTANCE IN PROVIDING EDUCATIONAL AND DEVELOPMENT YOUTH COMMUNITY PROGRAMMING IN THE CITY WITH A FOCUS ON PROMOTING MENTAL, PHYSICAL, AND EMOTIONAL WELL-BEING; ALLOCATING FUNDS FROM THE LAW ENFORCEMENT TRUST FUND, PROJECT NUMBER 19-690001, AWARD 1169, AND ACCOUNT CODE 12500.191602.883000.0.0, SUCH EXPENDITURES HAVING BEEN APPROVED BY THE CHIEF OF POLICE AND IN COMPLIANCE WITH THE DIRECTIVES PROVIDED IN SECTION 932.7055, FLORIDA STATUTES, AS AMENDED.

WHEREAS, pursuant to section 932.7055, Florida Statutes, law enforcement agencies are authorized to destroy the property, sell the property at a public auction, or retainthe property for official use by agencies for certain law enforcement purposes not considered normal operating expenses; and
WHEREAS, the provisions of Section 932.7055(5)(c)3, Florida Statutes, require that any a local law enforcement agency that acquires at least $15,000.00 pursuant to the Florida Contraband Forfeiture Act within a fiscal year must expend or donate no less than twenty-five percent (25%) of such proceeds for the support or operation of any drug treatment, drug abuse education, drug prevention, crime prevention, safe neighborhood, or school resource officer program or programs; and
WHEREAS, law enforcement agencies have the discretion to determine whichprogram or programs will receive the designated proceeds; and
WHEREAS, pursuant to Section 932.7055(5)(c), Florida Statutes, the recipient of suchproceeds shall certify that funds appropriated will be used lawfully and for the purpose stated, be required to maintain proper accounting records for the expenditure of such monies, and provide any reports, including but not limited to audit reports, as may be required; and
WHEREAS, the City of Miami ("City") Police Department ("MPD") deems it is imperativeto provide support to youth programs within the Cityβs jurisdiction dedicated in supporting crime prevention and safe neighborhood programs; and
WHEREAS, the Amplify Community Resources, Inc., a Florida not for profitorganizationACR, is committed to the education and development of the youth within underserved communities in the City to provide inspiration for success and positivelifechanges; and
WHEREAS, ACRβs youth programs are designed to focus onenhancingmental,physical,andemotionaloutcomestobenefittheyouthoftheCity; and
WHEREAS, ACR integrates social-emotional learning techniques andcomprehensive, evidence-based curriculum to provide positive life skills including relationship-building modules, physical activity, nutrition, conflict resolution and self-care; and
WHEREAS, MPD, in furtherance of its commitment to improving public safety within the jurisdictional boundaries of the City, wishes tosupport objectives of ACR andprovidefinancialassistance for programming to benefit the Cityβs underserved youth and building stronger andsafercommunities; and
WHEREAS, the funds necessary to support ACRβs expenditures have not been included in the MPDβs general operating budget and are available in MPDβs Law Enforcement Trust Fund (βLETFβ); and
WHEREAS, the Chief of Police recommends adoption of this Resolution and has determined that the proposed expenditure of funds comply with the requirements of Section 932.7055, Florida Statutes;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section.
Section 2.Β The MPD is authorized to provide a donation, in an amount not to exceed Seventy-Five Thousand and 00/100 Dollars ($75,000.00), to ACR allocated from MPDβs LETF Project Number 19-690001, Award 1169, and Account Code12500.191602.883000.0.0, for financial assistance in providing educational and development youth community programming in the City with a focus on promoting mental, physical, and emotional well-being in compliance with the directives provided in Section 932.7055, Florida Statutes.
Section 3. This Resolution shall become effective immediately upon its adoption.
