A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE AN OFF-SYSTEM CONSTRUCTION AND MAINTENANCE AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION (“FDOT”), FOR IMPROVEMENTS ON STATE ROAD 25 / NORTHEAST 36 STREET AT NORTHEAST 5 AVENUE, MIAMI, FLORIDA, FOR GENERAL ROADWAY IMPROVEMENTS IN THIS CORRIDOR, INCLUDING IMPROVEMENTS ON ROADS NOT ON THE STATE HIGHWAY SYSTEM.

WHEREAS, the Florida Department of Transportation (“FDOT”) has developed design plans Financial Management (“FM”) Project No. FM 446264-2-52-01 for the construction of safety improvements, installation of a new speed feedback sign and signing and pavement markings (“Project”),specifically along Northeast 5 Avenue from approximately 100 feet south to 100 feet north of the State Road 25 (“SR-25”) / Northeast 36 Street centerline (for purposes of this agreement, the “Off-System Project Limits”); and
WHEREAS, FDOT intends to undertake and complete the Project, a portion of which includes work on roads not on the State Highway System but a City of Miami (“City”) road and right-of-way, specifically on Northeast 5 Avenue; and
WHEREAS, the Project includes installation of a signalization pull box and conduits to connect to the existing electrical service point, sidewalk reconstruction and new pavement markings (“Local Roadway Improvements”) and all activities associated with, or arising out of the construction of the Local Roadway Improvements; and
WHEREAS, the Off-System Construction and Maintenance Agreement (“Agreement”), attached and incorporated as Exhibit “A,” establishes the terms, conditions, and responsibilities of FDOT and the City to accomplish the Project and Local Roadway Improvements on the City’s Streets; and
WHEREAS, the City agrees with the terms and conditions in the Agreement, in substantially the form attached and incorporated as Exhibit “A”;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized to execute the Agreement, in substantially the form attached and incorporated as Exhibit “A,” with FDOT, for the Project on SR 25 / Northeast 36 Street at Northeast 5 Avenue, Miami, Florida, which includes improvements on roads not on the state highway system, and the Local Roadway Improvements.
Section 3. This Resolution shall become effective immediately upon its adoption.
