AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 19, SECTION 19-2.1 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), TITLED "FIRE SAFETY PERMIT REQUIRED; ISSUANCE; FEES; ANNUAL RENEWAL; REVOCATION AND PENALTIES; USE OF FEES," TO CREATE SUBSECTION (G) TO REQUIRE THE ELECTRONIC SUBMISSION OF FIRE PROTECTION AND LIFE SAFETY SYSTEM INSPECTION, TESTING, AND MAINTENANCE REPORTS THROUGH A WEB-BASED SYSTEM, INCLUDING A THIRD-PARTY SYSTEM, DESIGNATED BY THE CITY; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN IMMEDIATE EFFECTIVE DATE.

WHEREAS, fire protection and life safety systems, including fire alarm systems, fire sprinkler systems, smoke control, BDA/ERCES and other fire and life safety systems, are critical for public safety; and
WHEREAS, the FFPC and the City of Miami Fire Code require periodic inspection, testing, and maintenance ("ITM") of these fire protection and life safety systems; and
WHEREAS, the City of Miami Fire-Rescue Department seeks to improve compliance monitoring, enhance fire safety oversight, and streamline reporting by requiring ITM reports to be submitted electronically through a third-party web-based system as permitted under Section 633.312(3)(a), Florida Statutes, and Florida Administrative Code 69a-46.041; and
WHEREAS, numerous jurisdictions within Florida, including Fort Lauderdale, Kissimmee, and St. Lucie County, have successfully implemented similar third-party reporting requirements; and
WHEREAS, the City Commission finds that requiring electronic submission of fire protection and life safety system ITM reports will increase the level of safety to the public and enhance the efficiency and effectiveness of fire safety enforcement in Miami;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section.
Section 2. Chapter 19, Section 19-2.1 of the City Code is further amended in the following particulars:
“CHAPTER 19
FIRE PROTECTION

Sec. 19-2.1 - Fire safety permit required; issuance; fees; annual renewal; revocation and penalties; use of fees.

(g)Electronic Submission of Fire Protection and Life Safety System Inspection, Testing, and Maintenance Reports.
(1)All fire alarm systems, fire sprinkler systems, fixed fire suppression systems, smoke control, BDA/ERCES, and any other fire protection and life safety systems that are required by the Florida Fire Prevention Code (FFPC), as amended by the City Code, to undergo periodic inspection, testing, and maintenance (ITM) must have their ITM reports submitted electronically through a web-based system, including a third-party system, designated by the City of Miami.
(2)Property owners and ITM service providers performing inspections must submit ITM reports through the designated web-based system within the timeframes required by the FFPC and City Code.

Section 3. If any section, part of a section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance shall become effective immediately upon final reading and adoption thereof.
